These Terms of Service (the "Terms") govern your access to and use of img-2-img.com, including our website, accounts, subscriptions, credits, and AI-powered image generation, transformation, editing, and enhancement tools (collectively, the "Service"). In these Terms, "we," "us," and "our" refer to the operator of img-2-img.com.

By creating an account, purchasing a plan or credits, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not access or use the Service.

Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. The Service is not directed to children or minors. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

You agree to provide accurate and current account and billing information, safeguard your login credentials, and accept responsibility for activity under your account. You may not share, sell, transfer, or permit another person to misuse your account. Notify us promptly at [email protected] if you suspect unauthorized access.

We may support sign-in through third-party authentication providers. Their services remain subject to their own terms and privacy policies.

Our Service and Business Model

img-2-img.com sells access to its own AI-powered digital services, subscriptions, and usage credits directly to customers. We are not a marketplace, seller platform, payment facilitator for users, peer-to-peer payment service, escrow service, bank, or money-transmission service. Users cannot sell products or services to one another, accept payments from other users, withdraw balances, or use credits to purchase third-party goods or services through img-2-img.com.

Features, supported formats, models, processing times, prices, output quality, and usage limits may change. We may add, modify, suspend, or discontinue a feature, model, plan, or integration where reasonably necessary for security, legal compliance, provider availability, or operation of the Service.

User Content, Rights, and Consent

User Content includes any image, prompt, mask, instruction, reference material, or other content that you submit to the Service. You retain any rights you lawfully hold in your User Content and remain solely responsible for it and for how you use, publish, or distribute any result.

By submitting User Content, you represent and warrant that:

you own it or have all licenses, permissions, and consents required to submit and process it for the requested purpose;
it does not infringe any copyright, trademark, privacy, publicity, contractual, or other right;
when an identifiable person appears in it, you have that person's valid consent for the requested editing, generation, and intended use, including commercial use where applicable;
it does not include confidential material that you are not authorized to disclose; and
both your request and intended use comply with these Terms and applicable law.

You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, process, store, display, and disclose User Content only as reasonably necessary to provide and secure the Service, perform safety review, prevent fraud and abuse, troubleshoot failures, comply with law, and enforce these Terms. This license ends when the relevant content is no longer reasonably needed for those purposes, subject to backup, billing, dispute, fraud-prevention, and legal-retention requirements described in our Privacy Policy.

Zero-Tolerance Prohibited Use Policy

You may not use or attempt to use the Service to create, upload, edit, transform, enhance, store, or distribute:

pornography, sexually explicit or sexually suggestive material, nudity, fetish content, sexual services, or any content intended for sexual arousal or gratification;
any sexualized, nude, exploitative, grooming-related, or abusive depiction of a minor or a person who appears to be a minor, including synthetic or fictional depictions;
non-consensual intimate imagery, sexual deepfakes, pornographic face swaps, hidden-camera material, or any intimate depiction created or shared without the depicted person's explicit consent;
deceptive impersonations, fraudulent identity materials, misleading deepfakes, harassment, stalking, threats, hateful content, or content intended to defame, exploit, or endanger another person;
material that infringes copyright, trademark, publicity, privacy, or other proprietary rights, including unauthorized characters, logos, photographs, artwork, celebrity likenesses, or removal of watermarks or copyright-management information without permission;
illegal products or services, regulated goods offered without required authorization, scams, fraud, money laundering, unauthorized transactions, stolen payment credentials, card testing, chargeback abuse, or other payment-network abuse;
malware, phishing materials, instructions facilitating serious wrongdoing, or content otherwise prohibited by applicable law; or
material designed to evade, probe, disable, or circumvent our safety filters, payment controls, usage limits, access controls, or other protective measures.

You also may not scrape the Service, overload it, interfere with its integrity, use harmful automation, resell access without written authorization, reverse engineer protected parts of the Service except where applicable law expressly permits it, or use the Service to build a competing model or service through unauthorized extraction.

These rules apply even if prohibited material is lawful in a particular location. We apply a zero-tolerance policy to adult sexual content and sexual exploitation. Attempts to disguise or repeatedly submit prohibited content are themselves violations.

Image Safety Review and Enforcement

We use automated safety systems to review input images before they are submitted for generation and output images before they are delivered. Automated image review currently applies to images; it does not mean that every text prompt or other input is automatically screened. We may also review reports and relevant account or task information manually when reasonably necessary.

Safety systems reduce risk but cannot detect every violation and may occasionally produce false positives or false negatives. We may reject an input, withhold access to an output, stop a task, restrict features, suspend an account, preserve relevant evidence, or report conduct where required by law or a service provider.

When our image-safety flow blocks a task before successful completion and delivery, the generation credit for that task is not consumed. This does not create a right to receive prohibited content or to bypass review. If you believe lawful content was blocked by mistake, contact [email protected] with the task details. We may review the decision but do not guarantee that blocked content will be restored or generated.

Outputs and Permitted Use

Subject to these Terms, any restrictions shown for a particular plan or model, and applicable law, you may use outputs for lawful personal or commercial purposes. We do not claim ownership of an output solely because it was generated through the Service. However, we cannot grant rights that we or you do not possess.

AI outputs may not be unique and other users may receive similar results. An output may not qualify for copyright or other protection, and it may resemble existing people, works, brands, or material. You are responsible for reviewing an output and obtaining any clearance, consent, or license needed before publishing, selling, advertising with, or otherwise using it. We do not warrant that any output is accurate, exclusive, non-infringing, suitable for commercial use, or lawful for your intended purpose.

Credits

Credits are limited, revocable units that may be used only to access eligible features of the Service. They are not money, electronic money, cryptocurrency, a bank deposit, a payment account, or stored monetary value. Credits have no cash value and may not be withdrawn, transferred, resold, exchanged, or used to buy third-party goods or services.

The quantity, usage cost, validity period, expiration rules, and other conditions applicable to credits are displayed when they are purchased or granted, in the relevant plan, or in your account. Promotional or free credits may have different conditions from purchased credits. Except where required by law or expressly stated by us, expired, used, forfeited, or promotional credits are not refundable or redeemable for cash.

Subscriptions, Automatic Renewal, and Cancellation

Plan features, billing frequency, price, currency, taxes, and included credits or usage are displayed before checkout. Payments are processed by third-party payment processors such as Stripe. We do not generally receive or store your complete payment-card number.

Unless checkout expressly identifies a purchase as non-recurring, monthly and annual subscriptions renew automatically until canceled:

a monthly subscription is charged at the start of each monthly billing period; and
an annual subscription is charged for the full year in one payment at the start of each annual billing period.

The renewal price presented at purchase continues to apply unless we give notice of a prospective change as required by law. Taxes, currency conversion, bank charges, or processor fees may apply depending on your location and payment method.

You can cancel without contacting support by signing in and going to User Center > My Subscriptions. Submit the cancellation before the next renewal date:

an active or trialing subscription is scheduled to cancel at the end of its current paid or trial period, as applicable, and will not renew after that date; and
a subscription in a past-due or unpaid status may be canceled immediately.

Cancellation stops future renewals after it becomes effective. It does not automatically create a refund, prorated refund, or credit, and it does not by itself remove credits already posted to your account. Previously issued credits remain subject to their applicable usage and expiration rules. You may also contact [email protected] if the self-service cancellation page is unavailable.

Refund and Billing-Error Policy

Because we provide digital services and allocate computing resources when a task is performed, completed generations, consumed credits, delivered digital services, and billing periods that have begun are generally non-refundable, except where required by law.

Cancellation does not automatically entitle you to a refund or a prorated refund. You may request a manual billing review within 7 days of the charge if:

you were charged more than once for the same purchase; or
a verifiable system failure prevented us from delivering the purchased digital service.

Email [email protected] with your account email, order or invoice reference, charge date, and a description of the issue. Eligibility for review does not guarantee a refund; we will assess service and payment records and respond based on the facts and applicable law.

Report any suspected unauthorized charge to us as soon as possible and secure the affected account and payment method. Nothing in this policy limits any non-waivable cancellation, refund, chargeback, or consumer right available under applicable law.

Intellectual Property Notices

The Service's software, design, branding, interfaces, documentation, workflows, and underlying technology are owned by us or our licensors and protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service or its underlying technology to you.

If you believe content processed or made available through the Service infringes your copyright, trademark, publicity, or other right, email [email protected] with:

your name, contact information, and physical or electronic signature;
identification of the protected work or right you claim has been infringed;
the specific content or location at issue, including any available URL or task reference;
a good-faith explanation of why the use is unauthorized; and
a statement that the information supplied is accurate and that you are the rights holder or authorized to act for the rights holder.

We may request additional information, restrict access to the identified material, notify the affected user, terminate repeat infringers, or take other appropriate action. A user who believes material was restricted by mistake may send a counter-notice identifying the material, its prior location, the basis for the objection, and the user's complete contact information. Where appropriate and legally permitted, we may forward notices or counter-notices to the affected parties. Submitting knowingly false or misleading notices may create legal liability.

Third-Party Services

The Service may rely on third-party authentication, payment, hosting, storage, analytics, content-safety, and AI-inference providers. Their availability and processing may affect the Service, and their own terms and policies may apply. We are not responsible for third-party services outside our reasonable control.

You may not use the Service in a way that violates a third-party model or provider policy applicable to a disclosed feature. We may restrict a feature or request where required by a provider, payment network, court, regulator, or applicable law.

Availability and Changes

We aim to keep the Service available, but we do not guarantee uninterrupted, secure, timely, or error-free operation. Processing delays, rate limits, maintenance, abuse prevention, model changes, provider outages, and failed generations may occur. We may make reasonable changes to the Service and these Terms, and will post updated Terms and revise the date above. Where required by law, we will provide additional notice before material changes take effect.

Suspension and Termination

We may reject content, restrict transactions, suspend features, freeze delivery, or terminate an account if we reasonably believe that you violated these Terms, supplied false information, infringed another person's rights, created security or legal risk, attempted an illegal or unauthorized transaction, abused payments or chargebacks, or exposed us or a provider to regulatory or network penalties.

We may act immediately in serious safety, fraud, exploitation, or payment-abuse cases. Where permitted by law, credits associated with fraud, payment reversal, abuse, or a terminated account may be canceled or forfeited. Termination does not eliminate accrued payment obligations, and sections that by their nature should survive will remain effective.

You may stop using the Service at any time. Deleting or abandoning an account does not by itself cancel a paid subscription; use User Center > My Subscriptions to cancel renewal.

Disclaimers

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, and accuracy.

AI outputs may be incomplete, inaccurate, offensive, unexpected, unusable, or unsuitable for your intended purpose. Safety review is not a guarantee that every violation will be detected. You are responsible for evaluating all inputs and outputs and for deciding whether and how to use an output in a lawful and responsible manner.

Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or other intangible loss arising out of or related to the Service.

If we are found liable for a claim arising from the Service, our aggregate liability will not exceed the greater of the amount you paid to us for the specific paid service giving rise to the claim during the three months before the event or USD $100. Some jurisdictions do not allow particular exclusions or limitations, so this section may not apply to you in full. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, awards, losses, costs, and reasonable legal fees arising from your User Content, your use of an output, your violation of these Terms, or your violation of applicable law or a third party's rights.

Governing Law and Disputes

The governing law and forum applicable to these Terms are subject to the mandatory laws and jurisdictional rules that apply to you and the operator of img-2-img.com. Nothing in these Terms deprives you of consumer protections or rights that cannot be waived by contract.

Before filing a formal claim, please contact [email protected] and provide enough information for us to try to resolve the dispute informally. Either party may seek urgent injunctive or protective relief where legally available.

General Terms

If a provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, asset transfer, or transfer of the Service, subject to applicable law. These Terms, together with policies and purchase terms expressly incorporated by reference, constitute the agreement between you and us concerning the Service.
